Procedure and special conditions of the OnLive Hybrid Sale - special terms and conditions
The following conditions are part of the auction conditions (see E, I there).
1. The horses on offer are all for inspection on the sales complex. Inspection times as follow:
Thursday, 29th May 2025: 9.00am to 6.00pm
Friday, 30th May 2025: from 9.00am
2. Bidders who do not themselves take part in the public auction on site have the option of following the auction live in real time (picture & sound from the auction location via live stream) via the Internet and also to place orders electronically.
3. The respective Sale begins with an auction catalogue of the horses to be auctioned on a platform on the Internet by the organizer. This involves the invitation to submit offers for these horses in accordance with the auction conditions of the organizer and these special terms and conditions. Bids that a bidder does not submit on site but via electronic orders (online live bidding bid) are sent directly to the auctioneer, who decides to the best of his knowledge whether to accept the bid. If a live bidding bid and a "room bid" are made at the same time, the "room bid" has priority. Bidders registered before the auction can submit their bid live online to the auctioneer. Participation in the bidding process through orders placed online for a bid is not an online auction in the legal sense. The purchase contract is accordingly concluded when the auctioneer is awarded the contract at the venue.
4. Orders placed online for bids can only be submitted via the mask installed on the platform for registered bidders. Bids for which the bidder has not declared that he agrees with the validity of these terms and conditions and the auction conditions of the organizer will not be accepted.
5. Bids can be made by show of hands on site (auction location) or online by live bidding bids. The live bidding bids submitted online during the auction are made on the installed mask: By clicking on the "Submit bid" button, the bidder submits his live bidding bid with binding effect to the auctioneer. Each bid is subject to the subsequent condition of submitting a higher bid. Until this condition occurs and, if a higher bid is not submitted, the bidder is bound by his bid until the bid is accepted. Bids that are below the minimum bid will not be accepted, even if the organizer does not receive a higher bid by the end of the auction. The purchase contract for the auctioned horse is concluded when the highest bid effectively submitted in this way is accepted.
6. An effective bid must correspond to the minimum bid and then be at least one bidding step above the previous bidder's bid. The bidder will be informed on the internet platform if his bid has been accepted and also if he has been outbid.

The minimum bid is EUR 1,000.00
7. Notification of the conclusion of the contract: The bidder who submitted the highest bid at the end of the auction and was therefore awarded the contract will be notified of this in writing by e-mail or in another way on a permanent data carrier. The receipt of the notification is the confirmation of the already concluded purchase contract and not an additional requirement for its conclusion. Bidders who have not submitted the highest bid will not receive any notification. After the bid, the name of the buyer will be announced in the auction results.
8. The organizer is entitled at its discretion to block registered bidders for important reasons for individual auctions, individual offers or for a certain period of time and thus to exclude them from participation. This is only permissible if there is an important reason from which it emerges that the continued existence of a legal relationship with the blocked person is no longer reasonable.
9. The organizer can cancel an auction at any time if it decides to do so at its reasonable discretion if there is an objective reason. In the event of system failures due to technical conditions, the organizer is also entitled to cancel the auction in whole or in part. In this case, the decision to abort will be communicated on the Internet platform with key words indicating the reason. The bids already submitted expire with the notification without replacement.
10. The organizer maintains a hotline during the ongoing auction, which can be reached in the period specified on the Internet platform with the fees stated there at the expense of the caller. This hotline is only used to resolve processing problems and not to accept bids. Neither promises nor contractual agreements of any kind are made via the hotline.
11. After full payment (purchase price and other costs), the purchased horse must be picked up by Saturday, 31st May 2025, 4 pm at the latest. From Saturday, 31st May 2025, all maintenance costs will be borne by the buyer. The removal may only take place after presentation of a receipt of payment certificate issued by the organizer. The horses are handed over with halfter.
