The present online sales terms have been translated and are deemed accurate. Nevertheless, the sale is governed by the German version of the sales terms, and in the event of discrepancies between the German and the English translation, the German version shall prevail.
General Terms and Conditions for the BBAG.Auction Platform
1. GENERAL INFORMATION AND SCOPE OF APPLICATION
1.1 Validity and scope
These General Terms and Conditions (GTC) govern the use of the services on bbag.auction, an exclusive offering of 3forONE AG, Obere Paulistr. 13, CH-8834 Feusisberg, in technical partnership with BBAG e.V. The GTC apply from the moment you register or use the platform and are binding for all users.
1.2 Contractual partners and purchase contracts
BBAG e.V. is your sole contractual partner for the purchase of horses through auctions. 3forONE AG acts exclusively as a technical service provider and intermediary without any involvement in the purchase contracts or the auction process.
1.3 Technical implementation
3forONE AG provides the technical infrastructure for the execution of online and hybrid auctions and is responsible for the technical functionality of the platform.
2. SUBJECT OF THE SERVICE
2.1 Technical infrastructure
3forONE provides the technical infrastructure for the execution of online and hybrid auctions. BBAG e.V. is solely responsible for the content, the execution of the auctions and all decisions regarding the participation or exclusion of bidders. 3forONE acts purely as a technical service provider and accepts no responsibility or liability for decisions made in connection with the execution of the auction, including the blocking or exclusion of users during an ongoing auction.
2.2
3forONE excludes all liability for damage or loss arising from the use of the platform, unless this was caused intentionally or through gross negligence on the part of 3forONE. This includes, but is not limited to, all decisions regarding the blocking, deletion or exclusion of users, which are made exclusively by BBAG e.V. 3forONE is not liable for any financial, legal or technical consequences resulting from the decisions of BBAG and accepts no responsibility for the content or legal framework of the auctions.
2.3 Technical adjustments
The user is responsible for adapting the technology required to use the platform at their own expense, if necessary. 3forONE is not liable for technical interruptions, delays or other disruptions caused by the user's technical circumstances or by external third parties, including decisions by BBAG that may have technical consequences.
2.4 Livestream and delays
The livestream offered on the platform during the auctions may be subject to technical delays depending on the user's internet connection and the performance of the devices used. 3forONE accepts no liability for delays or other technical disruptions caused by the user's individual internet connection or technical equipment. It is recommended that bids be submitted in good time to allow for possible delays.
2.5 Recommendations for bidding
To avoid delays and ensure that bids are recorded in time, it is strongly recommended that you focus on the platform's bid form, as it usually responds faster and more directly than the live stream. The live stream may experience technical delays due to internet connections and the performance of the devices used. The bid mask works in real time and is therefore the most reliable method for submitting bids on time and correctly. Users should be aware that bids placed solely on the basis of the live stream may not be recorded in time due to delays.
3. REGISTRATION AND USER ACCOUNT
3.1 Registration
Participation in auctions requires prior registration. Registration is done using a registration form provided by 3forONE AG. The decision to activate or block a user account lies solely with BBAG e.V.
3.2 Bid history and data access
As part of your participation in auctions via our platform, certain data relating to your bidding activity is processed. This includes information about placed bids, winning bids, and the chronological order of your bidding actions.
This information is:

sent exclusively to you via email, e.g., when you place a bid or become the highest bidder,

displayed anonymously during ongoing auctions on the respective horse pages – only the bidder’s country and flag are shown, never personal names or data,

not permanently stored in your user account – which only contains your personal profile information (e.g., name, address, email, VAT ID if applicable).
Your identity remains fully protected – no other users or third parties can view or link your bids to you.
BBAG e.V. is authorized to access and use auction-related data solely in accordance with its internal policies – for example, to ensure auction processing, prevent fraud, or compile statistics.
The legal basis for this processing is Art. 6(1)(b) and (f) GDPR (contract performance and legitimate interest).
3.3 Data updates
Any changes to the data provided during registration must be updated in the user account immediately. 3forONE AG is not responsible for any disadvantages arising from outdated or incorrect information.
3.4 Responsibility for the accuracy of the information
The user is responsible for providing correct and complete information when registering and using the platform. 3forONE AG accepts no liability for damage or loss resulting from incorrect, incomplete or misleading information provided by the user. If it transpires that a user has provided incorrect information, including an incorrect name, 3forONE AG reserves the right to block or delete the user account in question immediately without any claims against 3forONE AG arising from this.
4. PARTICIPATION IN AUCTIONS
4.1 Conclusion
Upon successful participation in an auction, a contract is concluded exclusively between the user and BBAG e.V. 3forONE AG is not a party to the contract and accepts no responsibility or liability for these contracts.
4.2 Auction rules and conditions of participation
BBAG e.V. sets the rules and conditions for participation in auctions, including the possibility of excluding users from participation. 3forONE AG has no influence on these decisions and accepts no liability for them.
4.3 Bidding on the platform
Before submitting a bid, users are obliged to check the amount displayed in the bid form. It is the user's responsibility to ensure that the amount displayed is correct before pressing the ‘Submit bid’ button. By pressing this button, the bid displayed is accepted as binding. Once the bid has been submitted, the amount cannot be withdrawn or changed.
5. LIABILITY AND INDEMNIFICATION
5.1 Liability of 3forONE AG
The liability of 3forONE AG is limited to intentional or grossly negligent conduct on its part. Any further liability, in particular for slight negligence, consequential damages or lost profits, is excluded.
5.2 Disclaimer for auction decisions
3forONE AG is not liable for actions or omissions on the part of BBAG e.V., including, but not limited to, decisions regarding the blocking or exclusion of users, the design of the auctions or the fulfilment of the purchase contracts.
5.3 Indemnification
The user indemnifies 3forONE AG against all claims by third parties resulting from the violation of rights or laws by the user. This also includes claims arising in connection with participation in auctions or the purchase of horses.
6. COPYRIGHT AND DATABASE RIGHTS
6.1 Copyright
The contents of the bbag.auction platform are protected by German and international copyright and database rights. All rights are reserved by 3forONE AG or the respective rights holders.
6.2 Use of content
The user may only use the content of the platform for the intended purpose. Any reproduction, distribution or other use of the content is prohibited without the express written consent of 3forONE AG.
7. TERM AND TERMINATION
7.1 Term
The user agreement is valid for an indefinite period and can be terminated by either party at any time, unless otherwise agreed.
7.2 Termination by the user
The user may terminate the agreement at any time by deleting their account. Any obligations already entered into with BBAG e.V. remain unaffected by this.
7.3 Termination by 3forONE AG
3forONE AG is entitled to terminate the user relationship at any time without notice if the user violates these Terms and Conditions or misuses the platform.
8. FINAL PROVISIONS
8.1 Changes to the Terms and Conditions
3forONE AG reserves the right to change these Terms and Conditions at any time with future effect. The changes will be communicated to the user by email or displayed the next time they log in. If the user does not object to the changes within two weeks, the amended Terms and Conditions shall be deemed accepted.
8.2 Prohibition of assignment
The user is not entitled to assign or transfer their rights or obligations under this user agreement to third parties without the prior written consent of 3forONE AG.
8.3 Applicable law
These terms of use are governed by Swiss law, excluding conflict of law provisions and the UN Convention on Contracts for the International Sale of Goods.
8.4 Validity of the current terms and conditions
Only the version of these General Terms and Conditions valid at the time of use shall apply. Upon publication of a new version, all future transactions shall be governed exclusively by the new Terms and Conditions; earlier versions shall cease to be valid upon publication of the new version.
